Prayer : Criminal Original Petition filed under Section 528 of BNSS, to direct the Special Court for trial of cases under SC/ST (POA) Act, Dindigul, to accept the surrender of the petitioner and consider his bail application on the same day in connection with Crime No.165 of 2025 on the file of the 2nd respondent Police.

ORDER
The petitioner is accused No.13 in Crime No.165 of 2025 on the file of the 2nd respondent Police. The said case was registered for the offence under Section 191(2), 191(3), 126(2), 296(b), 118(1), 109(1), 351(3) of BNS and Sections 3(1)(r), 3(1)(s) and 3(2)(va) of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. Therefore, the petitioner has filed this petition seeking a direction to the Special Court for trial of cases under SC/ST (POA) Act, Dindigul, to dispose of his bail application on the date of surrender.
2. The case of the prosecution is that on 03.07.2025 at about 10.15 p.m., near Eriodu Government Middle School, the accused persons abused the defacto complainant, by stating his caste name and also attacked the defacto complainant with knife. Hence, the case.
3. The petitioner/A13 along with A12 has already filed a petition before this Court in Crl.O.P.(MD)No.11915 of 2025 seeking the very same relief. Considering the fact that the occurrence is of retaliation to the earlier incident and also considering the fact that the petition filed by A1 and A2 2/4
was already dismissed, this Court, by its earlier order dated 25.07.2025, dismissed the said petition filed by this petitioner along with A12.
4. Since there is no change in circumstances after the dismissal of the earlier petition, this Court is not inclined to entertain this petition.
