PRAYER: Petition filed under Article 226 of the Constitution of India, to to call for the entire records relating to the impugned order passed by the Respondent No.1 in G.O.(D) No.543 Home (Prison VI) Department dated 30.04.2024 and to quash the same as illegal, consequently direct the first respondent to consider the representation submitted by the petitioner dated 26.03.2025 and to pass orders to release the petitioner's husband by name K.Singaravelu, W/o. Kaliyaperumal aged 55 years PID No.184524 now confined at Central Prison, Trichy on premature release scheme by taking into account of the petitioner's husband good conduct and expeditious process of considering recommendations of the advisory committee on humanitarian grounds as submitted by the respondents before this Court in WP(MD) No.2173 of 2014 dated 13.06.2024 in accordance with law within the time stipulated by this Court.

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] The prayer in the petition is to quash the impugned order passed by the first respondent in G.O.(D) No.543 Home (Prison VI) Department dated 30.04.2024 and consequently direct the first respondent to consider the representation submitted by the petitioner dated 26.03.2025 and to pass orders to release the petitioner's husband by name K.Singaravelu, W/o. Kaliyaperumal
aged 55 years PID No.184524 now confined at Central Prison, Trichy on premature release scheme by taking into account of the petitioner's husband good conduct and expeditious process of considering recommendations of the advisory committee on humanitarian grounds as submitted by the respondents before this Court in WP(MD) No.2173 of 2014 dated 13.06.2024 in accordance with law within the time stipulated by this Court.
2. The writ petition has been filed challenging the order dated 30.04.2024 on the file of the first respondent thereby rejecting the request made by the petitioner seeking premature release of her husband. The husband of the petitioner is a life convict and he is languishing in jail for more than 15 years. Ater rejection order the petitioner submitted further representation seeking premature release of her husband.
3. A perusal of the counter filed by the respondents as well as the submission made by the learned Additional Public Prosecutor reveals that on receipt of subsequent representation there is a proposal for consideration for premature release of the husband of the petitioner as per Rule 348 of the Tamil Nadu Prison Rules, 2024.
4. In view of the above the first respondent is directed to dispose the representation submitted by the petitioner seeking premature release of her husband as per Rule 348 of the Tamil Nadu Prison Rules, 2024 within a period of 12 weeks from the date of receipt of a copy of this order.
