COMMON ORDER The Government Orders in G.O.(1D)No.218, School Education (Pa.Ka.5(1)) Department, dated 20.06.2019 and the Clause 9(i) of G.O.(1D)No.393, School Education (Pa.Ka.5(1)) Department, dated 04.10.2019, are under challenge in the Writ Petitions. 2.The petitioners are working as Secondary Grade Teacher / Headmaster / Headmistress / B.T. Assistant. Due to surplus post, they were deployed to the needy School. As per G.O.Ms.No.256, School Education Department, dated 19.04.2017, a teacher is eligible to participate in the general counselling for transfer, only if he / she completed one year of service in that School. But, exemption was granted, permitting the deployed teacher to participate in the general counselling for transfer in the same academic year.
Subsequently, the Government has passed G.O.Ms.No.218, School Education (Pa.Ka.5(1)) Department, dated 20.06.2019. As per the Clause 9(i) of the said Government Order, a teacher can participate in the general transfer counselling only if he / she completed three years of service in the same School and no exemption is granted. As per the Clause 5(i) of the said Government Order, only after deploying the surplus teachers, steps must be taken for general transfer counselling. The number of Writ Petitions were filed, challenging the portion of the Government Order. This Court, by the order dated 27.08.2019, made in W.P.(MD)Nos.14188 of 2019 etc batch, has framed certain guidelines. The said guidelines read as follows:- "17. Therefore, in the interest of justice, this Court is inclined to modify the condition 9(i) of the G.O(1D).No.
218 School Education [Pa.Ka.5(1)] Department dated 20.06.
i) The petitioners, who are all coming under the categories of deployment or by promotions for the academic year 2018-2019, not completing one year of service in the present working place, are entitled to attend the General Transfer Counselling to be held for this academic year 2019-20, provided they have not attended the General Transfer Counselling prior to 1.6.2019 as per the impugned order passed by the respondent.
ii) The petitioners, who are all coming under the categories of deployment or by promotions for the academic year 2017-2018, not completing one year of 22/29
service in the present working place as on 1.6.2018, are entitled to attend the General Transfer Counselling to be held for this academic year 2019-20, provided they have not attended the General Transfer Counselling prior to 1.6.2019 as per the impugned order passed by the respondent.
iii) Clause 10 of the impugned order relates to priority category, the Secretary to Government is directed to pass appropriate orders, in view of letter No.21787/SE5(1) 2019-1, dated 26.8.2019, School Education Department, Secretariat, Chennai-9, within a period of two weeks from the date of receipt of a copy of this order.
iv) If any of the writ petitioners have not submitted their applications so far to seek their remedy, they are at liberty to submit their applications before the appropriate authority within a period of one week from the date of receipt of a copy of this order. This order is applicable only to the writ petitioners herein.
v) In the light of the aforesaid order, after receiving such applications from the writ petitioners, the authority concerned shall permit the writ petitioners to the forthcoming General Transfer Counselling for the academic year 2019-20, if they are otherwise eligible.
3.As per guidelines 1 and 2 of the said order, the teachers, who are all coming under the category of deployment or by promotions for the academic years 2017-2018 and 2018-2019, not completing one year of service in the present working place and also not completed one year of service as on 01.06.2018 respectively, are entitled to attend the general counselling for transfer to be held for the academic year 2019-2020, provided that they have not attended the general transfer counselling prior to 01.06.2019. This Court, in Clause (iv) in the said guidelines, has directed the petitioners therein, to submit applications to the authority, within one week. This Court has also held that the said guidelines are applicable only to the petitioners therein.
4.To implement the said order of this Court, the Government has issued G.O.(1D)No.393, School Education (Pa.Ka.5(1)) Department, dated 04.10.2019, permitting only the petitioners therein to participate in the general counselling for transfer. The petitioners have come out with the present Writ Petitions, challenging G.O.Ms.No.218, School Education (Pa.Ka.5(1)) Department, dated 20.06.2019 and the Clause 9(i) of G.O.(1D)No.393, School Education (Pa.Ka.5(1)) Department, dated 04.10.2019, permitting only the petitioners therein in the Writ Petitions covered by the order this Court dated 27.08.2019 passed in W.P.(MD)Nos.14188 of 2019 etc 23/29
batch. Subsequent to the order of this Court, the number of Writ Petitions are filed, challenging G.O.Ms.No.218, dated 20.06.2019 and the Clause 9(i) of G.O.Ms.No.393, dated 04.10.2019, restricting the benefit only to the petitioners covered by the order of this Court dated 27.08.2019. Clause 9(i) of G.O.Ms.No.218, was challenged by the teachers in a number of Writ Petitions on the ground that they are deprived of their right to participate in the general transfer counselling and fixation of minimum three years of service in the same School without any exemption, is arbitrary.
This Court, considering the said contentions, has permitted the teachers, who were deployed or promoted during the academic years 2017-2018 and 2018-2019, but not completed one year of service in the present working place and also not completed one year of service as on 01.06.2018 respectively to participate in the general transfer counselling for the year 2019-2020 provided that they have not attended the general transfer counselling prior to 01.06.2019. 5.Heard the learned counsel appearing for the petitioners, the learned Government Advocate appearing for the respondents and perused the materials available on record carefully. 6.From the materials on record, it is seen that the teachers were deployed or promoted before the general transfer counselling.
In view of the same, they were not able to participate in the general counselling for transfer for the particular academic year, when they were deployed or promoted. In such circumstances, the minimum working period of three years in the same School in respect of the teachers deployed or promoted, for participating in the general counselling for transfer, is invalid. Already, such teachers were deprived of from participating in the general transfer counselling and seeking posting of their choice. Having deprived of such teachers from participating in the general counselling for transfer after deployment or promotion, they cannot be made to wait for three more years for participating in the general counselling for transfer. This Court, by the order dated 27.08.2019, made in W.P(MD)No.
14188 of 2019 etc batch, by framing certain guidelines with regard to permitting the petitioners therein, who are all coming under the categories of deployment or by promotions for the academic years 2017-2018 and 2018-2019, not completing one year of service in the present working place and also not completing one year of service as on 01.06.2018 respectively, are entitled to attend the general transfer counselling for the year 2019-2020 provided that they have not attended general transfer counselling prior to 01.06.2019. The petitioners are similarly placed like that of the petitioners in W.P.(MD)Nos.14188 of 2019 etc batch, and they are entitled to the same benefit.
7.The learned counsel appearing for the petitioners in W.P. (MD)Nos.22483 and 22484 of 2019 submitted that in view of the interim order granted by this Court, the petitioners were permitted to participate in the general transfer counselling and some of the 24/29
teachers joined in the School on their choice. Some of them have retained in the very same School.
8.In view of the above, Clause 9(i) of G.O.(1D)No.393, School Education (Pa.Ka.5(1)) Department, dated 04.10.2019, restricting the benefit only to the petitioners in W.P(MD)Nos.14188 of 2019 etc batch, covered in the order dated 27.08.2019, is not valid. All the similarly placed persons, like that of the petitioners in W.P(MD) Nos.14188 of 2019 etc batch, are also entitled for the benefits given in the order dated 27.08.2019. The guidelines issued in the said order, are applicable to the petitions herein. In view of extending the order dated 27.08.2019, made in W.P.(MD)Nos.14188 of 2019 etc batch, the Clause 9(i) of G.O.(1D)No.393, School Education (Pa.Ka.5(1)) Department, dated 04.10.2019, restricting the benefits only to the petitioners in W.P.(MD)No.14188 of 2019, is set aside. 9.Insofar as W.P.(MD)Nos.
23046 and 23810 of 2019 are concerned, the petitioners have participated in the general transfer counselling and joined in the School on their choice. Therefore, no further orders are necessary in the said Writ Petitions. 10.With the above directions, these Writ Petitions are disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
