PRAYER :- For Bail in Crime No.254 of 2023 on the file of the respondent Police ORDER : The Court made the following order :- The petitioners/accused herein, who were arrested on 14.08.2023 for the alleged offence under Sections 147, 148, 294(b), 448, 506(ii), 436 and 379 IPC, Sections 3(1) and 4 of TNPPDL Act, 1992 and Section 3 of Explosives Substances Act, 1908, in Crime No.254 of 2023 on the file of the respondent Police, seeks bail. 1/3
2. The case of the prosecution is that due to the previous motive, the accused persons unlawfully assembled with deadly weapons, went to the defacto complainant's house, damaged his house hold articles and also threatened him with dire consequences. Hence, the complaint.
3. The learned counsel for the petitioners submitted that the petitioners are innocent persons and they were falsely implicated in this case and they never committed any offence as alleged by the prosecution.
4. Reading of the First Information Report shows that the country bomb was used by the accused persons at that time of making the above said attack.
5. Considering the facts and circumstances and also considering the grievous nature of offence, this Court is not inclined to grant bail to the petitioners. If the petitioners are released on bail, they may abscond, tamper the evidences and it will hamper the investigation process. Hence, this petition deserves to be dismissed and accordingly dismissed.
