ORDER

This Criminal Original Petition is filed to quash the impugned Charge Sheet in Spl.S.C.No.3 of 2023 on the file of the Special Court for Trial of Cases RU/SC/ST (POA) Act Cases, Ramanathapuram, which was filed for the offences under Sections 294(b) and 323 of IPC r/w. Sections 3(1)(r) and 3(1)(s) of SC/ST (Prevention of Atrocities) Act, 1989.

2. The allegation in the final report is that due to prior enmity, the petitioners attacked the de-facto complainant with hands, abused him in filthy language, and humiliated him on account of his caste and thus, committed the aforesaid offences.

3. The learned counsel for the petitioners would submit that the parties have now arrived at a compromise and have filed a joint compromise memo dated 05.11.2025.

The petitioners, namely Saktheeshwaran @ Sakthi @ Sakthieswaran (Aadhaar No.8379 9699 6156), and Kadir Vel @ Kathirvel (Aadhaar No.4293 4759 7377), and the 2nd respondent, namely Boominathan (Aadhaar No.3109 8635 0040), and the 3rd respondent, namely Deepak (Aadhaar No.3716 7726 3893), are present before this Court in person. They are identified by Mr.M.Narayanasamy, Special Sub Inspector of Police, Rameshwaram Town Police Station, Ramanathapuram District. All the parties confirmed the compromise arrived at between them.

5. The learned Government Advocate (Criminal Side) appearing for the first respondent, on instructions, would submit that no compensation was received by the de-facto complainant in terms of the Act.

Considering the nature of the allegations against the petitioners and in view of the compromise arrived between the parties, this Court is of the view that no useful purpose would be served in keeping the impugned final report pending trial. Accordingly, the impugned final report in Spl.S.C.No.3 of 2023 on the file of the Special Court for Trial of Cases RU/SC/ST (POA) Act Cases, Ramanathapuram is quashed and this Criminal Original Petition stands allowed. The petitioners shall pay a sum of Rs.5,000/- (Rupees Five Thousand only) as 3/5

costs to the Mediation and Conciliation Centre attached to this Bench forthwith and file a photocopy of the receipt along with a memo reporting compliance in the Registry. The joint compromise memo dated 05.11.2025 shall form part of this order.
