Mr.S.Ravi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.86 of 2018 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 8(c) r/w 20(b)(ii)(b) of NDPS Act in Crime No.86 of 2018 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that on receipt of secret information, the police party went near M.Perumalpatti, where, on seeing the police party, the first accused tried to run away from the place, however, A1 was caught hold by the police and also 1/3
recovered 2.2kgs of ganja from him and based on the confession of A1, the petitioner has been implicated in this case.
3.The learned Additional Public Prosecutor would submit that more than 8 previous cases have been registered against the petitioner. Out of the above said 8 previous cases only three cases are pending.
4.The learned counsel for the petitioner would submit that the petitioner is taking treatment for diabetics and kidney failure. Hence, on medical ground, she again filed this petition.
5.The earlier anticipatory bail application was dismissed by this Court considering the antecedents of the petitioner. Though the petitioner was granted anticipatory bail earlier, she did not execute the sureties. But, again and again she filed the petitions.
6.Considering the antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition stands dismissed.
