The petitioner with a grievance that the respondent has put up an extension box obstructing his access to his shop has submitted a representation and filed this writ petition for a Mandamus, directing the respondent to relocate the extension box by considering his representation, dated 24.05.2023.
2.The learned Standing Counsel appearing for the respondent BSNL submits that this extension box is in existence for several years. The land owner has not raised any objection, however, the petitioner being a tenant has filed this writ petition. 3.The petitioner by referring the photographs submits that the extension box set up by the respondent is obstructing access to his shop. It appears to be correct to some extent. 2/4
4.In view of the above, this writ petition is disposed of with a direction to the petitioner to identify some other suitable place for erecting the extension box. If the petitioner identifies a suitable place for shifting the extension box, the respondent shall consider the same and shall shift the extension box accordingly.
