ORDER
The writ petition is filed seeking a direction to the first respondent to consider the representation of the petitioner dated 06.03.2025 and dispose of the same in accordance with law within the time stipulated by this Court.
2.Heard the arguments of Mr.V.Thiyagarajan, learned counsel appearing for the petitioner and Mrs.A.Baskaran, learned Additional Government Pleader appearing for the respondents 1 to 3. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.The Petitioner submitted a representation before the first respondent seeking reconveyance of the land situated in Survey Nos. 84/1B, 87/1C, 87/1D and 87/2 in Pannapatti Village, Kadavur Taluk,
Karur District, mainly on the ground that the said lands were not utilized by the Government for the purpose for which they were acquired. 4.A Perusal of the documents filed in the typed set of papers would indicate that the subject properties were sold by the petitioner in favour of the State Government through a sale deed dated 29.07.1998 for valid consideration. The recitals in the said sale deed would indicate that it was an absolute sale in favour of the Government. The subject properties were not acquired by the Government as per the provisions of Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act. Therefore, the petitioner cannot rely on Section 101 of Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, to seek reconveyance of the land. Therefore, this Court is not inclined to entertain this Writ petition. Accordingly, the same is dismissed. No costs. 19.08.2025 NCC : Yes/No Index : Yes/No Internet : Yes/No cp
