Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the second respondent herein to consider the petitioner's representation dated 01.08.2023 in consonance with Section 10(3) of the Tamil Nadu Patta Pass Book Act, within a time frame stipulated by this Court. ORDER
The petitioner has submitted an application dated 01.08.2023 to the respondents that there are some corrections in the patta for the land in Survey No.140/5 and filed this writ petition that his application dated 01.08.2023 has not been considered by the respondents.
2. Ms.D.Farjana Ghoushia, learned Special Government Pleader, who takes notice for the respondents, on instructions, submits that the petitioner has submitted the above application dated 01.08.2023 before the first respondent/the Revenue Divisional Officer, Sivakasi. But, the 2/5
concerned jurisdictional Revenue Divisional Officer is the Revenue Divisional Officer, Vathirairuppu. Therefore, the first respondent has referred the petitioner's application to the concerned jurisdictional Revenue Divisional Officer, Vathirairuppu.
3. In view of the said submission, the Revenue Divisional Officer, Vathirairuppu, is suo motu impleaded as a respondent in this writ petition.
4. The petitioner is directed to submit a fresh application along with necessary documents before the Revenue Divisional Officer, Vathirairuppu, within a period of two weeks from the date of receipt of a copy of this order. If any such application is received, the Revenue Divisional Officer, Vathirairuppu, shall consider and dispose of the same, in accordance with law, after providing an opportunity of hearing to the necessary parties, within a period of four months thereon. 3/5
5. With the above direction, this writ petition is disposed of. No costs.
