JUDGMENT

(Judgment of the Court was delivered by N.Seshasayee, J.) The learned Additional Government Pleader submits that the appellant has died and circulated a copy of her death certificate.

2. The issue involved in this appeal is a challenge to an order of the learned Single Judge in W.P.(MD) No.2664 of 2015 by the second wife of a certain

employee seeking family pension. The learned Single Judge found that the employee concerned has contracted a second marriage even during the subsistence of the first marriage and the family pension etc., is being paid to the first wife.

3. Since the right to claim is personal to the appellant, in view of her death, nothing survives in this Writ Appeal and the same is dismissed as having become infructuous. No costs.
