PRAYER :-For Bail in Crime No.1011 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/Accused No.3 herein, who was arrested on 18.11.2021 for the alleged offence under Sections 457, 380 r/w 411 IPC, in Crime No.1011 of 2021, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that when the defacto complainant returned from Chennai on 12.09.2021, he found that his house was broken and valuable jewels and money were stolen by some one. Hence, the complaint. On suspicious, the respondent police arrested one Shankar @ Vettu Shankar, who is a professional thief. On his confession, that he has handed over the jewels which were robbed from the house of the defacto complainant to the petitioner. Hence, the petitioner was arrested.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution.

CRL OP(MD). No.19906 of 2021 4.The learned Additional Public Prosecutor submitted that there is no previous case against the petitioner.

5.Even though the petitioner has been arrayed as accused in this case, he has received the jewels only from the main accused. During the investigation the petitioner before the trial Court as well as the Principal District Judge, Tiruchirappalli, submitted that he has purchased the jewels from Lalitha Jewellery. That was not accepted by the Courts.

6.Considering the fact that the stolen articles have been recovered and no previous case is pending against the petitioner and also considering the period of incarceration, this Court is inclined to grant bail to the petitioner with conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.VI, Tiruchirappalli and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 14/12/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
