PRAYER :- For Bail in Crime No. 7 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner/Sole Accused herein, who was arrested on 14.08.2023 for the alleged offence under Sections 417 & 376 of IPC in Crime No.7 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution is as per the defacto complainant's version is that on false promise that the petitioner has love affair with the defacto complainant and he will marry her, the petitioner having sexual intercourse with the defacto 1/3

complainant for many times. But, later refused to marry her. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor submitted that investigation in this case is pending.

5. It appears that according to the defacto complainant on false promise of marriage, the petitioner having sexual intercourse with her for several times. When the defacto complainant demanded him to marry her, he refused. Both were subjected to medical examination. But, the result has not been received so far. Considering the seriousness of the allegation and considering the fact that the investigation is in initial stage, this Court is not inclined to grant bail to the petitioner. This petition deserves to be dismissed.
