ORDER
The writ petition is filed seeking a direction to the respondents 3 and 4 to survey the properties situated in Survey Nos.4/1B and 4/2A, Narasingam Bit 3, Kadachanendal, Madurai East, Madurai District, within the time stipulated by this Court.
2.Heard the arguments of M/s.V.Sujatha, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 to 4. Since no adverse order is passed against the fifth respondent, notice to the fifth respondent is dispensed with.
3.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
4.According to the petitioner, he claims right over the subject properties under the judgment and decree passed in O.S.No.205 of 2009, on the file of the District Munsif Court, Melur and the sale deed dated 07.02.2000. The patta for the subject properties stands in the name of the petitioner in Patta Passbook No.333117. The petitioner submitted an application before the official respondents on 19.04.2025 in Application No.2025/N123/24010929, seeking survey of the subject properties. The same has not been considered. Hence, the petitioner has come before this Court.
5.The learned Additional Government Pleader appearing for the official respondents would submit that the application submitted by the petitioner will be considered in accordance with law.
6. In view of the same, without expressing any opinion on the
merits of the matter, the respondents 3 and 4 are directed to consider the online application of the petitioner dated 19.04.2025 and pass final orders on its own merits within a period of eight weeks from the date of receipt of a copy of this order, after issuing notice to the petitioner, fifth respondent, neighbouring land owners and other interested parties. Accordingly, this Writ Petition is disposed of.
