Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S. M. KALIRAJ, Advocate for the petitioner and of M/S.P.R.PRITHVIRAJ, Advocate for Respondent No.1 and M/S.R.ANANDHARAJ, Additional Public Prosecutor for Respondent No.2 the court made the following order:- Anticipatory bail was already granted on the undertaking given by the accused that he will settle the matter within given time frame.
2.The present petition has been filed seeking to cancel the anticipatory bail alleging that the accused has not kept the promise and he is yet to pay Rs.5,20,000/-.
3.The learned counsel appearing for the accused would submit that within two weeks, the money will be paid and therefore, the anticipatory bail granted need not be cancelled. 4.This Court, which has already granted anticipatory bail to the accused herein, is not inclined to cancel the same in view of some alleged breach committed by the accused person subsequent to grant of anticipatory bail, more so, when the accused had promised to pay money within two weeks. Hence, the application to cancel the anticipatory bail is dismissed. The parties shall work out their remedy amicably, if they choose to do so.
