Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the respondents to grant financial upgradation under the Assured Career Progression Scheme with effect from the petitioner's eligibility w.e.f. 1999 and continue to pay the second and third MACP and revise the salary and grant all consequential benefits.

This writ petition has been filed for a direction to the respondents to grant financial upgradation under the Assured Career Progression Scheme with effect from the petitioner's eligibility and 1/3

continue to pay the second and third MACP and to revise the salary and grant all consequential benefits.

2. The learned counsel appearing for the petitioner would submit that seeking fixation of pay under the Assured Career Progression Scheme with effect from 23.04.1997, the petitioner has made a representation to the second respondent, on 20.03.2015. But, till date no order was passed. Hence, the present writ petition has been filed with the aforesaid prayer.

3. The learned Standing counsel appearing for the respondents would submit that the petitioner's representation dated 20.03.2015 was rejected on 06.06.2015 and the said rejection order was also communicated to the petitioner.

4. In view of the above, the relief sought for by the petitioner in this writ petition cannot be granted and if at all if the petitioner has any grievance, he has to challenge the rejection order. Accordingly, this Writ Petition is dismissed with liberty to the petitioner to work out the remedy, in the manner known to law. No costs.
