O R D E R

This writ petition is filed for a Mandamus, directing the third respondent to permit the petitioner to discharge his duties as Secretary of Q 633 Nerukuppai Primary Agricultural Co-operative Credit Society, Tirupathur Taluk, Sivagangai District. 2.Today(24.02.2023), when this writ petition is taken up for hearing, there is no representation for the petitioner. 3.The case of the petitioner is that the petitioner, who was working as Secretary of Q 633 Nerukuppai Primary Agricultural Co-operative Credit Society, Tirupathur Taluk, Sivagangai District was placed under suspension on 12.10.2015. Subsequently, the suspension order was stayed by this Court in W.P(MD) No.19219 of 2/5

2015. Despite the order of stay passed by this Court, the respondents have not permitted the petitioner to join duty. Therefore, the petitioner filed Contempt petition. In the meantime, the third respondent, by order dated 29.02.2016 has revoked the order of suspension, permitting the petitioner to join duty. However, he could not join duty as he suffered with heart attack and he underwent coronary angiogram. On recovery, when the petitioner submitted his representation on 07.03.2016 with an intention to join duty, he was not permitted to perform his duty. Therefore, this writ petition was filed.

4.The learned Government Advocate appearing for the respondents produced a written instruction that pursuant to the order of this Court dated 10.06.2016, the petitioner joined duty as the Secretary of Q 633 Nerukuppai Primary Agricultural Co-operative Credit Society, Tirupathur Taluk, Sivagangai District from 07.11.2018 onwards.

5.Recording the written instruction submitted by the learned Government Advocate, this writ petition is closed as no further order is required. No costs. Consequently, connected Miscellaneous Petition is closed.
