PRAYER: Contempt Petition filed under Section 11 of Contempt of Court Act, to punish the contemnors/respondents herein for their willful, wanton and utter disregard to the orders passed by this Court in W.P.(MD)No.7340 of 2025 dated 07.07.2025.

O R D E R

The learned Counsel appearing for the petitioner submitted that in spite of the tripartite agreement, the respondents have subsequently insisted to lay the road. Before this Court, both the parties stated that a tripartite agreement was entered into. A specific stand was taken by the respondents based on the tripartite agreement, the writ petition has become infructuous.

2. In fact, this Court refused to record such a statement since it cannot be infructuous. Therefore, this Court recorded that the earlier agreement has been replaced by the tripartite agreement. Now, the petitioner is taking a stand that the petitioner is not bound to relay the road. But the respondents are taking a stand that the petitioner is bound to relay the road. When there is no consensus under 2/5

the agreement then the tripartite agreement cannot be accepted.

3. Accordingly, this Court is inclined to recall the earlier order dated 07.07.2025 and post the writ petition in W.P.(MD)No.7340 of 2025 before the Portfolio Judge for rehearing. There shall be an order of interim stay of all proceedings until the writ petition is disposed of and Sub Application(MD)No. 339 of 2025 is accordingly ordered.
