ORDER

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

2. On 16.05.2020 at around noon, the petitioner was found roaming in violation of the lockdown restrictions. Hence, Crime No.629 of 2020 was registered on the file of the Samayanallur Police Station for the offences under Sections 188 and 269 of IPC r/w Section 3 of Epidemic Diseases Act, 1897.

3. The respondents could not have registered the FIR for the offence under Section 188 of IPC or under Section 3 of Epidemic Diseases Act, 1897. There is also nothing on record to show that https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P(MD)No.20296 of 2021 the petitioner contributed to the spread of disease. Since no adverse consequence ensued, the continuation of the impugned prosecution is not warranted. The impugned FIR is quashed. This Criminal Original Petition is allowed. Consequently, connected miscellaneous petition is closed.
