PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus calling for the records pertaining to the impugned proceedings of the second respondent in Na.Ka.A6/22254/2015 dated 04.01.2015 and to quash the same and direct the second respondent not to proceed in the T.S.No.2/2 of Trichy Town Survey (Old Survey No.264/1A1 of Ariyamangalam Village), pending disposal of the Civil Court proceeding in O.S.No.938 of 2014, O.S.No.1492 of 2014 and Ind.O.P.No.2 of 2015.

The petitioner had assailed a communication dated 04.01.2015 of the second respondent by which the petitioner was called for an enquiry. The main grievance of the petitioner is that there is a title dispute between the petitioner and the fifth respondent, which is pending before the jurisdictional civil Court.

2. Learned Government Advocate has placed before me a communication from the second respondent by which it is stated that the complaint would not be enquired until the pending proceedings are concluded. As such, the grievance of the petitioner has been redressed.

3. By recording the same, W.P.(MD).No.10644 of 2016 is disposed of without any order as to costs. Consequently connected W.M.P. (MD).No.8260 of 2016 is closed.
