Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Certiorari, to call for the records relating to the order passed by the 1st respondent in his proceedings in Mu.Mu.No.24725/F4/2022, dated 19.07.2022 and quash the same as illegal.

ORDER

The petitioner, claiming to be a Member of Naduvakurichi Pastorate of CSI, Thoothukudi Nazareth Diocese, has filed this writ petition as against the order of the 1st respondent dated 19.07.2022, in and by which, the first respondent granted approval for appointment of the 3rd respondent as Secretary of the Popes College, Sawyerpuram.

2. The learned counsel appearing for the petitioner submits that the 3rd respondent was not duly nominated by the Educational Agency. However, without ascertaining the same, the first respondent has recognized the 3rd respondent as Secretary of the Popes College, 2/5

Sawyerpuram. Therefore, it needs to be interfered with.

Mr.N.Dilip Kumar, learned counsel, who takes notice for the respondents 3 and 4, has filed a typed set of papers and submits that in the General Body Meeting dated 20.04.2022, an Educational Agency for Pope's College was constituted and the Educational agency has nominated the 3rd respondent as the Secretary of Pope's College by proceedings dated 20.04.2022. The first respondent, accepting the proposals made by the Educational Agency, has duly approved and appointed the 3rd respondent as the Secretary of the Pope's College under Rule 9(1) of the Tamil Nadu Private Colleges (Regulation) Rules.

4. Since the proceedure has been properly followed in appointing the 3rd respondent as the Secretary of the Pope's College based on the recommendation of the Educational Agency, this Court is not inclined to interfere with this writ petition. 3/5

5. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 07.09.2023 ogy NCC : Yes / No.
