PRAYER :- For Bail in Crime No.2 of 2022 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner / Accused No.13 herein, who was arrested on 08.08.2023 for the alleged offence under Sections 409, 465, 466, 477(A), 468, 471, 472, 109 of IPC, 1860 and Under Sections 13(2), 13(1)(C) and 13(1)(d)(i) of Prevention of Corruptions Act, 1988 and under Section 13(2) r/w 13(1)(a) of Prevention of Corruptions (Amendment) Act, 2018, in Crime No.2 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other third parties and Revenue officials have grabbed so many acres of Government Land and that they have fabricated documents by way of committing fraud and the bribe was 1/3

given and received for the process of grabbing Government land. Hence the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case. Hence, he seeks for the relief of bail.

4. The learned Additional Public Prosecutor would submit that the petitioner is aged about 75 years.

5. Considering the facts and circumstances of this case and also the fact that the petitioner is aged about 75 years old and considering the period of incarceration, this Court is inclined to grant relief to the petitioner.

6. Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Chief Judicial Magistrate, Theni, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. sd/- 05/09/2023 / TRUE COPY / 05/09/2023 Sub-Assistant Registrar (C.S. ) Madurai Bench of Madras High Court, Madurai - 625 023.
