ORDER

The petitioner is accused in Spl.S.C.No.16 of 2024 on the file of the Principal Special Court for Exclusive Trial of Cases under POCSO Act, Theni. By judgment dated 24.07.2025 the petitioner has been convicted for the offence under Section 8 of Protection of Children from Sexual Offences Act 2012 and sentenced to undergo three years rigorous imprisonment and to pay a fine of Rs.25,000/-, in default, to undergo six months simple imprisonment. The Trial Court has suspended the sentence imposed on the petitioner till 08.09.2025. Challenging the above said conviction and sentence, the petitioner has preferred CrlA(MD)No.942 of 2025 along with this petition seeking suspension of sentence.

2.This court while entertaining this petition has granted interim suspension of sentence till 23.09.2025 with certain conditions and directed the Registry to list the matter on 23.09.2025. However thereafter 2/4

this petition has not been listed and the petitioner has neither taken any steps for obtaining extension of the interim suspension nor had surrendered before the respondent police. Therefore, this court is not inclined to entertain this petition. Accordingly, this petition is dismissed with liberty to surrender before the respondent police and renew the application.
