PRAYER :- For Bail in Crime No.100/2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/Accused No.13 herein, who was arrested on 10.08.2023 for the alleged offence under Sections 109, 147, 148, 153A, 294(b), 307, 506(ii) of IPC and 1/4

Section 3 of TNPPDL Act, in Crime No.100 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that due to previous enmity, on 03.08.2023 at about 06.00 p.m., the when the defacto complainant along with his people standing near Pandian Grama Bank, the accused persons came there with aruval, abused the defacto complainant with filthy language, criminally intimidated him and caused injuries upon him, thereby attempted to murder. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. There was a communal problem between two groups of people, whereby, both parties assaulted each other. Counter complaint has been registered in Crime No.99 of 2023.

4.The learned Additional Public Prosecutor submitted that there are 9 previous cases pending against this petitioner. The petitioner is a history sheeted person. Some of the accused persons in this case have been released on anticipatory bail. 5.Considering the period of incarceration only, though the petitioner is having previous cases, this Court is inclined to grant bail to the petitioner with stringent conditions.

6.Accordingly, this Criminal Original Petition is allowed and the petitioner is 2/4

ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Srivillipthur, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
