PRAYER :- For Bail in Crime No.100 of 2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners/Accused Nos.19 and 29, who were arrested on 10.08.2023 for the alleged offence under Section 109, 147, 148, 153A, 294(b), 307, 506(ii) of IPC and Section 3 of TNPPDL Act, in Crime No.100 of 2023, on the file of the respondent 1/3

police, seeks bail.

2.The case of the prosecution is that due to previous enmity, on 03.08.2023 at about 06.00 p.m., the when the defacto complainant along with his people standing near Pandian Grama Bank, the accused persons came there with aruval, abused the defacto complainant in filthy language, criminally intimidated him and caused injuries upon him, thereby attempted to murder. Hence, the complaint. 3.The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. There was a communal problem between two groups of people, whereby, both parties assaulted each other. Counter complaint has been registered in Crime No.99 of 2023.

4.The learned Additional Public Prosecutor submitted that some of the accused persons in this case have been released on anticipatory bail. 5.Considering the facts and circumstances of this case and considering the period of incarceration and co-accused have been granted anticipatory bail, this Court is inclined to grant bail to the petitioners with certain conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioners are ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the 2/3

satisfaction of the learned Judicial Magistrate No.I, Srivilliputhur, and on further condition that the petitioners shall report before the respondent police daily at 10.30 a.m. until further orders.
