(Order of the Court was delivered by G.R.SWAMINATHAN, J.) Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for the respondents 1 to 5 and the learned counsel appearing for the sixth respondent.

2. The respondents concede that survey No.732/18B belongs to the writ petitioner. But their allegation is that the petitioner had also encroached upon the adjacent Adhidravidar natham land and that is 2/5

3 W.P.(MD)NO.22737 OF 2019 why, action was taken in respect of the petitioner's occupation in survey No.732/6. The petitioner's counsel would argue that survey was not done properly. But, that would be a different cause of action altogether. The scope of this writ petition is to protect the petitioner's peaceful possession and enjoyment of the petition-mentioned land in survey No.732/18B. On this, there is no dispute whatsoever. Recording the stand of the respondents that they would not disturb the petitioner's peaceful possession and enjoyment of the petition-mentioned land in survey No.732/18B, this writ petition stands allowed. No costs. Consequently, connected miscellaneous petition is closed.
