For Respondent : Mr.R.Meenakshi Sundaram, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.1012 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.2 who apprehends arrest at the hands of the respondent police for the offence punishable under sections 147, 148, 294(b), 324, 307 & 506(ii) of IPC r/w 3 of TN Public Property (Prevention of Damages & Loss) Act, in Crime No.1012 of 2021 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the defacto complainant is a Auto Driver. On 07.11.2021, at about 09.00 p.m, on receipt of phone call coming from Balaji Tea Shop, he and his friends dropped one Masilamani in his house because, he was in drunken mood. After dropping the above said person, he found that the auto key was missing and when he enquired the petitioner and the other accused, who were standing near the auto, about the missing auto key, the petitioner along with other accused said to have abused the defacto complainant and his friends in filthy language and brutally attacked him with deadly weapons and caused damage to the auto and caused https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.19956 of 2021 blood injuries to him. Hence, this complaint. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution. He would further submit that A1 was remanded to the judicial custody and A3 to A5 have been granted anticipatory bail. Hence, he seeks anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor would submit on 07.11.2021, at about 09.00 p.m, out of simple issue, the alleged occurrence said to have taken place. The injured has been repeatedly assaulted by hands, aruval etc., insofar as the petitioner is concerned he is arrayed as second accused and he assaulted the injured with aruval. He would further submit that 8 cases are pending against this petitioner and among which, most of the cases are murder cases.
