2. Heard the learned Additional Government Pleader appearing for the petitioner and the learned counsel appearing for the respondent.

3. Despite giving sufficient opportunity to file a counter-affidavit, the respondent has failed to do so. Being satisfied with the reasons stated in the accompanying affidavit, the delay of 69 days is condoned and the petition is ordered.
