The Writ Petition is filed seeking a direction to the respondents 1 and 2 to consider the Petitioner's application, dated 23.7.2025 seeking survey of the property in Town Survey NO. 87/17A2 situated at T.Arasapatti Village, Madurai District. 2.Mr.D.S.Nedunchezian, learned Government Advocate takes notice for the respondents 1 to 3 and Mr.M.Vaikkam Karunanithi, learned Government Advocate(Crl.side) takes notice for the respondents 4 and 5. By consent of both parties, the Writ 2/6
Petition is taken up for final disposal at the admission stage itself. 3.According to the Petitioner, the subject property was gifted to her by her mother Velammal under registered gift deed dated 7.1.2022. Patta for the subject property also stands in the name of Petitioner in Patta No.3457.The Petitioner submitted an application on 23.7.2025 in Application No.2025/0123/24/018178 seeking survey of the subject property. The same has not been considered till date. Hence the Petitioner has come before this Court with the present Writ Petition for the relief stated supra. 4.Mr.D.S.Nedunchezian, learned Government Advocate who takes notice for the respondents 1 to 3 would submit that in view of the resistance bythe neighbouring land owners, the process of survey could not be carried out.
5.In view of the said submission made by the learned Government Advocate appearing for the respondents 1 to 3 without expressing any opinion on the merits of the matter, the first respondent is directed to consider the online application submitted by the Petitioner on 23.7.2025 and pass final orders on its own merits after issuing notice to the Petitioner, neighbouring land owners and other interested parties, if any, within a period 3/6
of 12 weeks from the date of a copy of this order. 6.With the above directions, the Writ Petition stands disposed of. No costs.
