Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records pertaining to the Impugned Order in Na.Ka.1618/2016 Saba, dated 31.01.2017 on the file of the Respondent and quash the same as illegal and consequently for a direction, directing the Respondent to permit the Petitioner to retire from service and disburse the eligible pensionary benefits to the Petitioner within the time period stipulated by this Court.

ORDER

This writ petition is filed to quash the impugned order, dated 31.01.2017 with consequential relief to permit the petitioner to retire from service and to disburse all the eligible pensionary benefits.

2. Heard Mr.G.Karthik, for M/s.Lajapathi Roy, learned counsel appearing for the petitioner and Mr.K.S.Selvaganesan, learned Additional Government Pleader, appearing for the respondents. Perused the material documents available on record.

3. Today, when the matter is taken up for hearing the learned counsel appearing for the petitioner submitted that the surcharge proceeding has been completed against all the delinquents, except the petitioner. Thereafter, the petitioner also retired from service and terminal benefits were also granted. The submission is recorded.

4. In view of the aforesaid submission, nothing survives for adjudication in this matter. If there is any monitory benefit is pending, the same 2/4

shall be disbursed to the petitioner. The petitioner is at liberty to claim, in accordance with law.

5. With the above observations and directions, this Writ Petition is closed. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
