(R3 is suo motu impleaded vide Court order, dated 22.06.2016 in W.P(MD)No.10993 of 2016):Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to issue the First Information Report to the petitioner, for petitioner's complaint, dated 07.11.2009, which was given to the second respondent for missing of petitioner's passport, by way of considering petitioner's representation, dated 22.01.2016. O R D E R

This Writ Petition has been filed seeking direction to direct the 2nd respondent to issue the First Information Report to the petitioner, for petitioner's complaint dated 07.11.2009, which was given to the second respondent for missing of petitioner's passport, by way of considering petitioner's representation, dated 22.01.2016. 2.It is seen that the petitioner has lodged a complaint on 11.07.2009 on the allegation is that the petitioner's passport was missing. Subsequently, the petitioner has also sent a representation on 22.01.2016 before the second respondent police. https://hcservices.ecourts.gov.in/hcservices/

W.P.(MD)No.10993 of 2016 3.The learned Government Advocate (Crl.side) appearing for the respondent police would submit that no complaint is pending on the file of the second respondent.

4.Considering the above submission made by the learned Government Advocate (Crl.side), the petitioner is directed to lodge a fresh complaint before the second respondent police forthwith. On receipt of the same, the second respondent is directed to registered the FIR and issue certificate to the extent that the missing passport is non-traceable within a period of two weeks from the date of receipt of a copy of the complaint.

5.With the above direction, this Writ Petition stands disposed of. No costs.
