PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order of the second respondent dated 14.08.2015, vide his proceedings letter No.f.vz;.br.bgh/.n.fh/K/bjh.E.c.1/Bfh.fh.eP/m.vz; 151/2015/2016 and quash the same and consequently directing the respondents to provide agriculture electricity connection on par with the other tenants within the time frame fixed by this Court. This writ petition is filed challenging the orders of the second respondent, dated 14.08.2015, rejecting the representation of the petitioner seeking electricity service connection, based on the application made by the erstwhile tenant.
2. The petitioner is a cultivating tenant of the lands in Survey No.46 to an extent of 11 Acres, belong to Ayyampalayam Sree Thandayuthapani Anna Chatram Private Trust, Ayyampalayam. 2/6
He entered as a tenant in the year 2013. The erstwhile tenant of the above land made an application for free electricity service connection with the electricity Board on 29.07.1995 and the same has not been effected even after due acknowledgment on 03.08.1995. Subsequently, the petitioner has entered as a tenant in the above lands. Therefore, he made a request for grant of electricity service connection based on the earlier application submitted by the erstwhile tenant on 29.07.1995 and the same was rejected that though the application was made by the erstwhile tenant in the year 1995, the applicant has not shown his readiness and willingness for effecting the service connection. Therefore, it got lapsed and the application of the petitioner was rejected by the respondent. Aggrieved over the same, the present writ petition is filed. 3.The petitioner has made a representation dated 24.12.2014, for considering his representation based on the application of the erstwhile tenant made in the year 1995 and that was rejected by the Department. Therefore, this writ petition is filed. 3/6
4.This writ petition is pending before this Court for the past six years. This Court is of the view that the application submitted by the petitioner itself might have reached its seniority in the allotment of electricity service connection. Therefore, this Court is inclined to dispose of this Writ petition with a direction to the respondent Board to consider the application of the petitioner, dated 24.12.2014, by giving priority in effecting electricity service connection to the petitioner, with effect from 24.12.2014. 5.Accordingly, this writ petition is disposed of.
