Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the first respondent to change the investigation of the petitioner's case in Cr.No.40/2025 from the file of the 2nd respondent to any other agency or officer based on petitioner's representation dated 30.07.2025.

O R D E R

The petitioner's elder son, namely Selvendiran has committed suicide on 21.01.2025, in the house of one Shanthi, for which, a case in Crime No.40 of 2025 has been registered for the offence under Section 194 of BNSS Act. Alleging that the bank account of his son was operated by some unknown persons even after his son's death, the petitioner has lodged another complaint. It is also alleged that the mobile phone of his son is with the Sub Inspector of Police, one Ramesh Babu. However, no action has been taken by the respondent police. Since the petitioner is not satisfied in the manner, in which, the respondent police is dealing with his complaints, he has approached this Court, seeking transfer of investigation.

2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor, who takes notice for the first respondent submits that the complaint of this petitioner as against the said Shanthi was enquired and a separate case has been registered as against her in Crime No.151 of 2025. He further submits that the investigation officer has found that the 2/5

mobile phone of the petitioner's son is with one Ramesh Babu, the Sub Inspector of Police and therefore, they have also added him as an accused in Crime No.151 of 2025. According to the learned Additional Public Prosecutor, the investigation in this case is being conducted in a proper manner and necessary action has also been taken as against the Sub Inspector of Police.

3.Considering the submissions of the learned Additional Public Prosecutor, this Criminal Original Petition is closed with the direction to the respondent police to ensure that the investigation in Crime No.40 of 2025 is conducted in a fair and proper manner. The Deputy Superintendent of Police, Aranthangi shall monitor the investigation.
