The defacto complainant in Crime No.155 of 2024, on the file of the respondent police has filed this petition, seeking a direction to the respondent police to conclude the investigation in the above crime number, within a stipulated time.

2.The learned counsel appearing for the petitioner submits that the petitioner was attacked with sickle by seven persons, for which, he has lodged a complaint before the respondent police and the same was registered in Crime No.155 of 2024 on 27.05.2024. According to the learned counsel, the petitioner was assaulted with a sickle and a complaint has been lodged as against seven persons. However, the case was registered as if this petitioner was attacked with a stick and some of the accused have been omitted in the First Information Report. According to the petitioner, the respondent police has not registered the case in a proper manner. With this averment, this petitioner has filed an application before this Court in the month of March 2025, seeking a direction to transfer the investigation in Crime No.
155 of 2024, wherein, the respondent police have taken a stand that this petitioner has lodged a complaint as against four unknown persons and now he is taking a new stand that he has been attacked with a sickle by seven persons. It is also reported that the investigation in Crime No.155 of 2024 was almost completed and the final report was also made ready. Recording the said submissions of the respondent police that the investigation in Crime No.
155 of 2024 has been completed and the final report was also made ready in the month of March, 2025, this Court, by its order dated 20.03.2025 has dismissed that petition that the relief of transfer of investigation cannot be considered at that stage, when the investigation has already been completed. The grievance of the petitioner is that even after their submission before this Court in Crl.OP(MD) No.5110 of 2025, dated 20.03.2025, the respondent police has not filed the final report so far and therefore, the petitioner is constrained to file this petition. 3.Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the respondent submits that though it has been mentioned in the earlier petition that the investigation has been concluded, they have examined five witnesses so far and they need some more time to conclude the investigation.
4.This Court considered the rival submissions made and also perused the materials placed on record.

5.The petitioner with a grievance as against the investigation agency has already filed an application seeking transfer of investigation in Crime No.155 of 2024, wherein a representation has been made on behalf of the respondents as if the investigation has been completed. However, it appears that the investigation has not been completed and a false representation has been made before this Court, in order to defeat the earlier petition filed by this petitioner. In view of the above, it can be inferred that the investigation in Crime No.155 2024 has not been conducted in a proper manner.
6.Considering the manner, in which, the investigation has been conducted, the Superintendent of Police, Trichy is directed to withdraw the case in Crime No.155 of 2024 from the file of the respondent police along with the counter case, if any registered and the same shall be entrusted with some other sincere investigation officer other than the respondent police for a fair and proper investigation. The Superintendent of police shall also look into the manner, in which the instructions have been provided in the earlier petition filed by the petitioner 4/6
7.With the above observations and directions, this Criminal Original Petition is closed.
