ORDER
The Petitioner has filed the above Writ Petition to issue a Writ of Mandamus, directing the 3rd Respondent to grant permission and provide a police protection to take the procession of Mulaipari and Milk Pot by the women folk and five men through the 4th Chariot Street and anoint the milk over the statue of the Velpoori Maamannar Maruthupandiyars which are situated in Velpoori, Rameswaram, Ramanathapuram District on 27.10.2022 at about 10.00 a.m. by considering the Petitioner's representation dated 10.10.2022. 2.The learned Government Advocate(Crl.Side) takes notice for the Respondents. By consent, the Writ Petition itself is taken up for final disposal. 2/6
3.Heard the learned Counsel for the Petitioner and the learned Government Advocate(Crl.Side) appearing for the Respondents. 4.The learned Counsel appearing for the Petitioner would submit that he is the President of Akamudiyar Munnetra Arakkattalai and submit that every year the people of Tamil Nadu as well as the Country celebrate the Guru Pooja in grand manner on 27th October for the People who fought against British people for our Country's freedom. This year also they are going to celebrate the said function, hence he seeks direction.
5.The learned Government Advocate(Crl.Side) appearing for the Respondents would submit that the Petitioner is seeking permission for procession by women folk and five men through the 4th Chariot Street and anoint the milk over the statue of the Velpoori Maamannar Maruthupandiyars ar Ramanathapuram. It is the specific finding of the first Respondent that in all those years they have only conducted the festival at Sivaganai and this is the first time seeking permission to conduct the festival at Ramanathapuram Town in the four radha veedhi , which is found objectionable by the Superintendent of Police. 3/6

Considering the fact that there is prohibitory order issued under Section 144 (1) of Cr.P.C in the Ramanathapuram District by the District Collector on 07.09.2022 and in the light of the submission made by the learned Government Advocate(Crl.Side) this Court cannot grant exemption. In view of the same, the objection of the learned Government Advocate(Crl. side) regarding law and order issue is accepted.
