PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to call for the records in Crime No. 179 of 2023 dated 24.04.2023 registered on the file of the 2nd respondent and quash the same as illegal in respect of the petitioner. O RDER This petition is filed under Section 482 of Cr.P.C. seeking for quashment of FIR in Crime No.179 of 2023, dated 24.04.2023, registered against the petitioner for the offences under Sections 147, 379 and 464 of I.P.C.

2. It is submitted that according to the respondent Police, the petitioner has tampered the trip sheet and committed soil theft. It is submitted that the respondent Police have not recovered any soil which was alleged to have been committed theft and the petitioner has shown the original trip sheet to the Court. According to him, it has not been tampered and the respondent Police have not considered the same.

3. In view of the submissions made above, the petitioner is permitted to approach the respondent Police and file the original permit, on which, the respondent Police are directed to consider the same. In case, if the trip sheet has not been tampered after due enquiry with the Mines Department, consider the same during the course of investigation and complete the investigation as quickly 2/4

as possible not later than three months from the date of receipt of a copy of this order.

4. With the above direction, the Criminal Original Petition is disposed of.
