ORDER

This Petition is filed to condone the delay of 479 days in filing the petition to restore the Civil Miscellaneous Appeal in CMA(MD).No.2042 of 2013, which was dismissed for default on 28.04.2023.

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. For the reasons stated in the accompanying affidavit filed in support of the Petition, though not satisfactorily explained, in the interest of justice, this Petition is allowed, however, on condition that the Petitioner pays a sum of Rs.2,000/- (Rupees Two Thousand only) towards costs to the credit of Legal Services Authority, attached to this Bench on or before 17.11.2025.
