Vaikkam Karunanithi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.14 of 2022 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioners/A1 to A4, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 417, 376, 323, 109 & 506(i) IPC in Crime No.14 of 2022, seek anticipatory bail.
2.The case of the prosecution is that the first petitioner by giving false promise to the defacto complainant, has physical contact with her for the past four years on various days. Since on https://www.mhc.tn.gov.in/judis 1/2

No.18493 of 2022 27.07.2022 betrothal function was performed for the defacto complainant with another person, the first petitioner brought her to his house, where the petitioners have abused her and threatened her with dire consequences. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. Hence, the learned counsel seeks for anticipatory bail to the petitioner. 4.The learned Government Advocate (criminal side) appearing for the respondent police would submit that in this case, investigation is pending. Hence, he strongly opposed to grant anticipatory bail to the petitioners.
6.Considering the facts and circumstances of the case and also considering the gravity of the offence and also considering the fact that the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioners at this point of time. 7.Accordingly, this Criminal Original Petition is dismissed. sd/- 02/11/2022 / TRUE COPY / /11/2022 Sub-Assistant Registrar (C.S.)
