PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 03.11.2015, to change the petitioner's community as "Vanniyar" instead of "Servai" in the Transfer Certificate issued by the second respondent.

O R D E R

This writ petition is filed for a Mandamus, directing the respondents to change the petitioner's community as "Vanniyar" instead of "Servai" in the Transfer Certificate issued by the second respondent, by considering the petitioner's representation dated 03.11.2015.

2.The learned counsel appearing for the petitioner submits that the petitioner originally belongs to "Vanniyar" Community. However, in her Community Certificate, the second respondent has wrongly noted her community as "Servai". Therefore, the petitioner sent a representation to change her community in the Transfer Certificate. Since the same was not considered by the respondent, the petitioner has filed this writ petition.

3.The learned Additional Government Pleader appearing for the first respondent submits that though the petitioner has claimed that she belongs to Vanniyar Community, she has not produced any relevant documents to that effect. He further submits that the Transfer Certificate has been issued by the Department of School Education, based upon the Community Certificate of the petitioner alone.

4.Heard the learned counsel on either side and also perused the materials placed on record.

5.Though the petitioner claims that she belongs to Vanniyar Community, the petitioner has not substantiated the same with the community certificate. The respondent has also taken a specific stand the community mentioned in the Transfer Certificate is depending upon the Community Certificate alone. Since the petitioner has not placed the community certificate to substantiate her contention that she belongs to Vanniyar community, this writ 3/5

petition is dismissed with a liberty to the petitioner to approach the concerned Revenue Authorities. No costs.
