Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the 1st Respondents impugned order RA.5(1)/15722/2018 (E.A.No.01/2018) dated 13.09.2018 and quash the same as it devoid of merits and direct the 1st Respondent to give suitable recommendation to the 4th respondent to consider the change of address and renewal of licence No.4/2010 for the retail sale of fireworks and crackers for his new premises at Door No.6/315-A Lenin Street, Paramakudi Taluk, Ramanathapuram District by considering petitioner's representation dated 24.03.2017 within the stipulated period as fixed by this Court. Mr.A.Haja Mohideen, learned counsel for petitioner is before this Court.
2. On coming to know about the contempt petition, the respondent Officer in instant contempt petition is present before https://hcservices.ecourts.gov.in/hcservices/ 1/2
CONT.P(MD)No.1561 of 2019 this Court voluntarily and learned Additional Government Pleader, Mr.Aayiram K.Selvakumar representing the respondent Officer, C.Muthumari, Additional District Magistrate / District Revenue Officer, Ramanathapuram, Ramanathapuram District is also before this Court.
3. Learned counsel for petitioner in the instant contempt petition as well as the learned State counsel submit that an intra Court appeal being W.A.(MD)No.1098 of 2019 was filed by State against the order dated 05.09.2019 in W.P.(MD)No.20709 of 2018, out of which, instant contempt petition arises. It is submitted by learned counsel on both sides that in the aforesaid intra Court appeal, C.M.P.(MD)No.9852 of 2019 had also been taken out.
4. It is submitted that counsel for petitioner in instant contempt petition was on caveat before the Hon'ble Division Bench of this Court. It is submitted without any disputation or disagreement by both sides that an interim direction has been given by the Hon'ble Division Bench of this Court today and that both parties will now stand governed by the said order of the Hon'ble Division Bench.
5. In the light of the narrative thus far, instant Contempt Petition is closed. Consequently, Sub application being SUB APPLICATION(MD)No.265 of 2019 is closed.
