P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the first respondent to issue free site patta for the land in S.No.20 situated at Thirukampuliyur Village Group, Krishnarayapuram Taluk, Karur District admeasuring about 25 cents and situated on the south west corner of the said Survey Number out of the total extent of 6 acres in the name of the petitioner Trust on the basis of the petitioner's application dated 05.08.2024. ORDER

The petitioner only seeks limited relief of consideration of the petitioner's representation for issuance of patta.

The case of the petitioner is that the temple has been in possession and enjoyment of the subject lands for several decades and the ancestors of the deponent of the affidavit filed in support of the writ petition have been managing the temple activities, which includes laudable charitable activities like, Annadanam, facilitating functions for weaker sections of society, etc., The Petitioner was being threatened by 2/5

the revenue officials with forcible disposition and also removal of the constructions effected by the petitioner and therefore, the petitioner chosen to register the trust on 4.1.2023 and made an application on 17.11.2023 to the second respondent seeking patta, which was forwarded to the third respondent by proceedings dated 23.11.2023. As no action was taken by third respondent on the said representation, the petitioner has given a representation to the first respondent on 05.08.2024 seeking free house site patta. The petitioner followed up the said request with the reminder on 11.9.24 and presently seeks disposal of the representation dated 5.8.2024 made to the first respondent.

3. I have heard the counsel for the petitioner as well as the learned Government Advocate appearing for the respondents.

4. Without going into the merits or entitlement of the petitioner for patta, since the application made by the petitioner has been pending for over a year, that is from 5.8.2024, it would suffice to issue a direction to the first respondent, the Commissioner of Land Administration to 3/5

consider the petitioner's application for issuance of patta on its own merits and in accordance with law and pass final orders within a period of twelve weeks from the date of receipt of a copy of this order.
