CRL MP(MD) No.12825 of 2022 Side)on behalf of the Respondent, the court made the following order:- The Criminal Miscellaneous Petition has been filed seeking orders to condone the delay of 58 days in filing the Criminal Revision Case. This petition has been filed seeking permission of this Court to appear before the trial Court in the 1st working day as directed in Cr.M.P.(MD)No.6351 if 2022 in Crl.A.(MD)No.365 of 2022 dated 09.06.2022 by condoning our absence on 03.10.2022 pertaining to the case in S.C.No.126 of 2020 on the file of the learned Special Court for Trial of Cases Under SC/ST Act(POA), Thoothukudi. 2.There is no representation for the petitioners. 3.Report has been received from the trial Court. It shows that after 01.08.2022, the petitioners have not complied the condition. When the petitioners have not complied the condition, the question of relaxation does not arise. Even as per the petition, they stated that only on 03.10.2022, they did not appear. But, report of the trial Court shows contra facts.
4.In view of the above said discrepancy, this Criminal Miscellaneous Petition is dismissed. The petitioners are directed to comply the condition strictly.
