ORDER

The Civil Miscellaneous Petition has been filed seeking orders to accept the cause title as stated in memorandum of grounds of second appeal filed against the judgment and decree, dated 25.07.2023 passed in A.S.No.42 of 2005 by Principal Sub Court, Srivilliputhur. 2.The learned counsel for the petitioner would submit that since the suit was dismissed as against the sole defendant, she filed an appeal. During the pendency of the appeal, the appellant died and hence, her husband and daughter were impleaded as appellants and that the appeal was dismissed. Subsequently, the daughter of the original defendant died, and as such, the husband of the original defendant, the first appellant, filed the second appeal. He would further submit that the deceased Ramya Vihasini executed a will in favour of her father Velayutharaja. 2/4

3. Considering the fact that the present petitioner was an appellant in the first appeal, this petition is ordered.
