PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the first respondent to initiate proceedings under Section 34-A of the Tamil Nadu Societies Registration Act, 1975 for the supersession of the usurped committee of Kollemcode Vattavilai Sree Bhadrakali Educational Society, having register number 22/77 and appoint an administrator for the purpose of administering and conducting of election of the committee.

ORDER

The present writ petition has been filed seeking for Mandamus directing the first respondent to initiate proceedings under Section 34-A of the Tamil Nadu Societies Registration Act, 1975 by superseding the fourth respondent Society and appoint a Special Officer for conducting management and administration of the fourth respondent educational society.

2. Admittedly, a period of the Office Bearers of the fourth respondent Society has expired in the year 2019. The plea of superseding the Committee was based upon the allegations of the Office Bearers, who were in office between 2016-2019. The tenure of the Office Bearers have already come to an end and new Office Bearers have taken charge from the year 2019. Hence, the prayer for superseding the Committee of the period 2016-19 does not survive for any adjudication.

3. Therefore, this Writ Petition is dismissed as infructuous. However, the petitioner is at liberty to initiate independent proceedings, if he has got any grievances as against the present Office Bearers. No costs. Consequently, connected Miscellaneous Petition is closed. 27.06.2022 Index :
