PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to consider the petitioner under OBC Category and declare the petitioner as qualified for the post of Assistant Professor in the UGC NET Examination - July 2018 on the basis of the Mark secured by the petitioner and issue National Eligibility Certificate to the petitioner within the time period stipulated by this Court. ORDER
This Writ Petition is filed to direct the respondents to consider the petitioner under OBC Category and declare the petitioner as qualified for the post of Assistant Professor in the UGC NET Examination - July 2018 on the basis of the Mark secured by 1/3
the petitioner and issue National Eligibility Certificate to the petitioner.
2.According to the petitioner, he made a representation on 10.08.2018 before the respondents 2 and 3 seeking to consider the petitioner under OBC Category and declare the petitioner as qualified for the post of Assistant Professor in the UGC NET Examination - July 2018 on the basis of the Mark secured by the petitioner and issue National Eligibility Certificate to the petitioner.
3.In reply, the learned counsel appearing for the second respondent would submit that the aforesaid application is pending and the same shall be considered as expeditiously as possible on merits and in accordance with law, within a time frame to be fixed by this Court.
4.In view of above, without expressing any opinion on the merits of the case, this Court directs the 2nd respondent to consider the petitioner's representation dated 10.08.2018 and pass appropriate orders, within a period of 12 weeks from the date of receipt of a copy of this order, after providing due opportunity of hearing to the petitioner.
5.With the above direction, this Writ Petition is disposed of. No costs.
