Heard Mr.N.Sundaresan, learned Counsel appearing for the Petitioner, Mr.M.Ajmal Khan, learned Additional Advocate General assisted by Mr.S.Shanmugavel, learned Additional Government Pleader 2/7
for the respondents 2 to 5 and Mr.K.Sanjay Gandhi, learned Government Advocate for the 6th respondent.
2.This Writ Petition has been filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 2 to 6 not to interfere in the functioning of the petitioner institutions, vis: "Tamil Nadu Women Electro Homeoathy Medical College", "Tamil Nadu College of B.Sc., MLT" and TAMILNADU Vocational Training Centre" at Door No.451/6a, Pandalkudi Road, Aruppukottai under their control and possession of the petitioner. 3.Mr.N.Sundaresan, learned Counsel appearing for the petitioner, submits that the respondents 2 to 6 are interfering with the petitioner's institutions without any authority.
4.Mr.M.Ajmal Khan, learned Additional Advocate General assisted by Mr.S.Shanmugavel, learned Additional Government Pleader for the respondents 2 to 5 and Mr.K.Sanjay Gandhi, learned Government Advocate for the 6th respondent submits that as on today, there is no 3/7
cause of action arises in this Writ Petition and as per the instructions, the respondents 2 to 6 are not interfering with the petitioner's institutions, whereas, the petitioner institutions have no valid recognition or affiliation as per the records. He further submits that it is open to the petitioner to make a representation before the respondents and the respondents would then consider and decide on the matter in accordance with the law within a time frame fixed by this Court. 5.The learned Counsel for the petitioner agreed to the submissions made by the learned Additional Advocate General for the respondents 2 to 6 and submits that the petitioner is willing to file a fresh representation before the 2nd respondent, which may be directed to be disposed of within a specified time frame.
6.After hearing the submissions made by the learned Counsel for the parties and without going into merits of the case, this Court directs the petitioner to file a fresh representation before the 2nd Respondent/the District Collector, Virudhunagar District, Virudhunagar, detailing his claim and grievances, annexing therewith a certified copy of this order 4/7
within a period of two weeks from today. If any such representation is filed by the petitioner before the 2nd Respondent, as per the time stipulated by this Court, the 2nd Respondent/ the District Collector, Virudhunagar District, Virudhunagar, is directed to consider the same and pass a reasoned and speaking order on merits and in accordance with law, after giving sufficient opportunity to the Petitioner, within a period of four weeks from the date of receipt of such representation. The 2nd respondent shall communicate the order/decision to the petitioner through Registered Post with Acknowledgement Due (RPAD) within a period of two weeks from the date of passing the order/decision. 7.With the above directions, this Writ Petition is finally disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
