ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned Registration Deed by the 2nd respondent in Reg. No.24/2022 dated 26.02.2021 and consequently, to direct the respondents 1 and 2 not to register or entertain any identical name with the petitioner's association.

2.The petitioner is the Ex-President of the Association namely "Roll Ball Association of Tamil Nadu." The petitioner has challenged the registration of the third respondent, which is named as "Sports Tamil Nadu Roll Ball Association". The contention of the petitioner is that the name of the 3rd respondent association is similar to the name of the petitioner's association. 3.It is seen that the third respondent has added the word "Sports" in their name. Therefore, the names are not confusing and the allegation is not true. 4.The learned Counsel appearing for the third respondent submitted that the said association was not renewed after 2016 and now, it has become 2/4

defunct.

5.Even if it is so, this Court has rendered a finding that the name is not confusing. If the petitioner is aggrieved, he is permitted to file a civil suit. If any civil suit is filed, the Trial Court may consider it uninfluenced by any of the observations made supra.

6.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
