O R D E R
The Writ Petition is filed seeking a direction to the third respondent to consider the Petitioner's application for sub division and for issuance of separate patta by considering his application dated 16.5.2025.
2.Mrs.S.Jeya Priya, learned Government Advocate takes notice for the respondents 1 to 3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
3.According to the Petitioner, the subject property in S.No. 708/3A1 situated at Ananthapuram Village,Thovalai Taluk, Kanniyakumari District was allotted to the Petitioner's husband Bhagavathi Perumal Pillai under Partition deed, dated 25.4.1985.The Petitioner's husband died on 26.6.1992, leaving behind the Petitioner and his two children as his legal representatives. Therefore, the Petitioner submitted the instant application on 16.5.2025 seeking sub division of the property and for issuance of patta in the name of Petitioner and other legal 2/5
heirs. The said application has not been considered so far. Hence the Petitioner is before this Court with the present Writ Petition for the relief stated supra.
4.Mrs.S.Jeya Priya, learned Government Advocate who takes notice for the respondents 1 to 3, would submit that the application submitted by the Petitioner will be considered on its own merits, within the time stipulated by this Court. 5.In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider a the application of the Petitioner, dated 16.5.2025 and pass final orders on its own merits after issuing notice to the Petitioner and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order.
6.With the above directions, the Writ Petition stands disposed of. No costs.
