PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd Respondent to comply the directions of the 1st respondent letter No.Ko.14/2024/UPo-2/ThiruVi/Dt. 29.07.2024 by surveying the land in survey Nos.4 and 8 Mamsapuram Village within a time to be fixed by this Court, till then restrain the 1st respondent not to take coercive steps against the Petitioner.

ORDER

The petitioner seeks survey of the land in S.Nos.4 and 8 Mamsapuram Village on the basis of the directions issued by the first respondent on 29.07.2024.

2.Learned Government Advocate accepts notice on behalf of both the respondents. He submits that a water channel runs through S.No.8. He also submits that efforts to carry out a survey were taken earlier but there were encroachers and that the proceedings to evict encroachers were taken. He further submits that the survey would be undertaken after putting the petitioner and other interested parties on notice.

3.In view of the above submissions of learned Government Advocate, this writ petition is disposed of by directing the second respondent to act on the petitioner's request for survey in S.Nos.4 and 8 after putting the petitioner and the owners of the adjacent land on notice. This exercise shall be completed within 12 weeks from the date of receipt of this order. No costs. Consequenlty, connected writ miscellaneous petition is also closed. 17.09.2025 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 2/3
