Heard Mr.R.Venkatesan, learned Counsel for the petitioner and Mr.S.Gokulraj, learned Counsel for the respondent. 2.Mr.R.Venkatesan, learned Counsel for the petitioner submits that this Criminal Miscellaneous Petition has been filed under Section 5 of the Limitation Act, 1963, seeking to condone the delay of 147 days in filing the above Criminal Revision Case.

3.This Court, vide orders, dated 17.09.2025 and 15.10.2025, had already granted time to the learned Counsel for the respondent to file a counter affidavit for the respondent. However, when the matter is being taken up today, no counter affidavit has been filed for the respondent. It appears that the learned Counsel for the Respondent is not interested to file counter affidavit in the present petition.

4.Being satisfied with the reasons stated in the affidavit filed in support of this Criminal Miscellaneous Petition, the delay of 147 days in filing the above Criminal Revision Case is condoned.
