For Respondent : Mr.S.Manikandan, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.1110/2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused No.1 apprehending arrest at the hands of the respondent police for the offences punishable under sections 379 of I.P.C. and 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.1110 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner is trying to transport the river sand illegally by using the tipper lorry bearing Reg.No.TN 67 AD 4959. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Due to previous motive, this false case has been foisted against him.

4.The learned Government Advocate (Crl. Side) submitted that the petitioner is having one previous case in Crime No.147 of 2021, similar in nature, on the file of the very same police station. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.19985 of 2021 5.Since the petitioner is having one previous case of similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. The learned counsel for the petitioner submitted that the petitioner may be granted anticipatory bail on some stringent conditions. Such sort of request cannot be accepted by this Court.
